When they had brought up as to who heard footsteps, it was of a woman's heels. Not once did they ever prove that anyone heard a man's footsteps, so how could they prove that Bert had planted the bomb in Sharkey's office, given that no one heard Bert's footsteps. The only time they could prove that he set the bomb in Sharkey's office, was when the bomb was removed from Frieda's car.
